Terms of Service

1 Definitions

"Platform" refers to the EventMann website and all associated services. "User" means any person who accesses or uses the Platform. "Organizer" means a User who creates and manages events. "Attendee" means a User who purchases tickets or registers for events. "Vendor" means a User who provides services to Organizers. "Content" means any text, images, videos, or other materials uploaded to the Platform.

2 Eligibility & Account Registration

You must be at least 16 years old to use EventMann. By registering, you represent that you meet this requirement. You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your password and for all activities under your account. You may register with email/password or via social login (Google, Facebook, LinkedIn). You must contact us immediately if you suspect unauthorized access to your account.

5 Fees, Payments & Stripe Connect

All payments are processed through Stripe Connect. EventMann does not directly handle, store, or process payment card data — all payment information is entered into Stripe's PCI-DSS Level 1 certified payment form. Service fees are displayed transparently during checkout before purchase. The platform commission rate is determined by the Organizer's pricing plan and is deducted automatically by Stripe before funds reach the Organizer's account. Stripe charges its own processing fees (typically ~2.9% + €0.25 per transaction) which are separate from EventMann's platform fee. Organizers receive payouts directly from Stripe to their connected bank account — typically within 2 business days. EventMann does not control Stripe's payout schedule. All prices are displayed in the currency selected by the Organizer. Currency conversion fees, if applicable, are handled by Stripe or your card issuer.

6 Refunds & Cancellations

Refund policies are set by each Organizer and displayed on the event page. Options include: no refunds, full refund within 24/48 hours or 7 days of purchase. Organizers may cancel events at any time. If an Organizer cancels an event, all confirmed attendees are entitled to a full refund processed automatically via Stripe. EventMann is not liable for event cancellations, postponements, or changes made by the Organizer. Chargebacks and payment disputes are handled through Stripe's dispute resolution process.

7 Content & Intellectual Property

You retain ownership of Content you upload to EventMann. By uploading Content, you grant EventMann a non-exclusive, worldwide, royalty-free license to use, display, and distribute that Content solely for the purpose of operating the Platform (e.g., displaying your event page to potential attendees). EventMann's platform, brand, logo, design, and software are owned by ChetsApp UG and protected by copyright and trademark law. You may not copy, modify, or create derivative works of our Platform without written permission.

8 Prohibited Conduct

You agree not to: create fraudulent events or listings; impersonate any person, organization, or entity; use the Platform for money laundering, terrorist financing, or other illegal activities; distribute malware, spam, or unsolicited communications; scrape, crawl, or extract data from the Platform without authorization; circumvent security measures, rate limits, or access controls; harass, abuse, or threaten other users; post content that is defamatory, obscene, or violates third-party rights; use bots or automated tools to purchase tickets or manipulate availability. Violation of these rules may result in immediate account suspension or termination.

10 Account Suspension & Termination

EventMann may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, receive excessive chargebacks, or if required by law. We will provide notice when possible, but reserve the right to act immediately in cases of fraud or security threats. You may delete your account at any time from your profile settings. Upon deletion, your personal data will be removed within 30 days (except where retention is required by law). Organizers must resolve all pending bookings and payouts before account deletion.

11 Privacy & Data Protection

Your use of EventMann is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Platform, you consent to data processing as described in our Privacy Policy. We comply with the EU General Data Protection Regulation (GDPR) and applicable German data protection law.

12 Disclaimers

EventMann is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. We are not responsible for the actions, content, or conduct of Organizers, Attendees, Vendors, or any third party. We do not endorse any event listed on the Platform. Event quality, safety, and compliance are the sole responsibility of the Organizer.

13 Limitation of Liability

To the maximum extent permitted by law, ChetsApp UG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from: event cancellations, postponements, or changes by Organizers; payment processing failures or delays by Stripe; loss of profits, data, or business opportunities; unauthorized access to your account (where you failed to secure your credentials); actions of other users on the Platform. Our total liability for any claim shall not exceed the fees you paid to EventMann in the 12 months preceding the claim.

14 Indemnification

You agree to indemnify and hold harmless ChetsApp UG, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from: your violation of these Terms; your Content or event listings; your breach of any applicable law; disputes between you and other users. This indemnification obligation survives termination of your account.

15 Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes arising from these Terms or your use of EventMann shall be subject to the exclusive jurisdiction of the courts of Munich (München), Germany. For EU consumers: you may also file complaints with your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/odr.
